False Claims Math Doesn’t Work for PA!

With a state False Claims Act (FCA) highlighted as a revenue generator in Gov. Shapiro’s 2026-27 budget proposal, it’s important to take a closer look at the numbers and the actual impact a FCA would have on the state. PCCJR Executive Director Curt Schroder and PA Manufacturers’ Association President and CEO David Taylor did just that in a recent PMA Bulletin.

While a state FCA is being pitched as a silver bullet to the Commonwealth’s budget woes, examples from other states show that it would not bring in nearly as much as has been touted. In fact, depending on the percentage fee the relator (the private plaintiff/bounty hunter who filed the case) receives, Pennsylvania could actually lose money. A more detailed analysis shows that given the state’s already low Medicaid error rate (one of the lowest in the nation), the Commonwealth fares better under the status quo of the federal False Claims Act.
