House Bill 1913 – Inflating Damages via “Anchoring”

This week’s outrageous bill is a threat to a sound and balanced civil justice system. HB 1913 would allow plaintiffs’ attorneys to argue damages amounts in closing arguments. Plaintiffs’ attorneys will then engage in “anchoring” tactics to manipulate juries into awarding damages that far exceed levels they would reach if left to decide an amount based on evidence presented at trial, and their life experiences. Anchoring tactics include suggesting a huge financial sum or a mathematical formula (an amount per day or per hour) designed to lead to outrageous nuclear verdicts (and huge paydays for plaintiffs’ attorneys).

The growing trend of nuclear verdicts is already having a negative impact on our state and is a leading cause of our continuous ranking as one of the country’s worst judicial hellholes. House Bill 1913 will only exacerbate this problem – raising costs across the board for every day consumer items because large verdicts contribute to the cost of products and services. This legislation was passed by the House Judiciary Committee this week and now goes to the full House for consideration.
