A change in the Commonwealth’s treatment of third-party litigation funders (TPLF) could be on the horizon. The Civil Procedural Rules Committee of the Pennsylvania Supreme Court has issued a notice of rulemaking to implement a Third-Party Litigation Funding Rule that will require documents pertaining to third-party litigation funding to be produced during discovery. This effort seeks to bring parity to defendants who are required to produce insurance policies that will fund verdicts or settlements. PCCJR is studying this proposal and seeking input from members and interested parties. The Rules Committee is accepting comments until April 22.
